Acceptance of Terms

By accessing the website at newsmyrnabeachepoxyflooringandconcretepolishing.com, requesting a quote, or engaging New Smyrna Beach Epoxy Flooring & Concrete Polishing ("Company," "we," "us," or "our") for any service, you agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not use our website or services.

These Terms and Conditions apply to all visitors to our website and all customers who engage us for concrete flooring services. We may update these terms at any time by posting a revised version to this page.

Description of Services

New Smyrna Beach Epoxy Flooring & Concrete Polishing provides concrete flooring and surface preparation services, including but not limited to epoxy floor coatings, polyaspartic coatings, polished concrete, stained concrete, terrazzo flooring, concrete resurfacing, pool deck coatings, and related services.

All services are performed by or under the direction of licensed and insured professionals. Services are available to residential and commercial customers throughout our service area in Florida. We reserve the right to decline any project at our discretion.

Estimates and Pricing

We provide free written estimates following an on-site assessment of the project. Estimates are based on the condition of the concrete, the scope of work described, and the products and systems selected. An estimate is not a final contract until both parties have agreed to the scope and signed a written proposal or work order.

Estimates are valid for 30 days from the date issued unless otherwise noted. Prices may change if the scope of work changes after the estimate is accepted, or if conditions discovered during work differ materially from what was observed during the estimate visit.

We do not provide binding quotes over the phone or without an in-person assessment. Any verbal pricing discussion is an approximation only.

Scheduling and Cancellation

Scheduling is confirmed in writing or by phone. We make reasonable efforts to complete work on the agreed schedule, but delays may occur due to weather, material availability, or conditions discovered on-site. We will notify you promptly if a scheduled date needs to change.

If you need to cancel or reschedule, please notify us as soon as possible and no fewer than 48 hours before your scheduled start date. Cancellations made with less than 48 hours notice may result in a fee to cover preparation and scheduling costs, as specified in your written proposal.

We reserve the right to postpone work if weather or site conditions create a risk of coating failure or safety hazards. In such cases, we will reschedule at the earliest mutually convenient time at no additional charge.

Customer Responsibilities

Before work begins, the customer agrees to:

• Clear the work area of all vehicles, furniture, equipment, and stored items
• Ensure safe and unobstructed access to the work area
• Disclose any known conditions that may affect the work, including prior coatings, cracks, chemical exposure, or moisture issues
• Keep people and pets out of the work area during application and curing
• Provide adequate ventilation access as directed by our crew

Failure to fulfill these responsibilities may delay the project or result in additional charges. We are not liable for coating failures caused by conditions the customer did not disclose.

Payment Terms

Payment terms are outlined in the written proposal or work order for each project. In general:

• A deposit may be required to reserve a project date
• The remaining balance is due upon project completion unless otherwise agreed in writing
• Accepted payment methods will be specified in your proposal
• Past-due balances may be subject to a late fee as specified in the written agreement

Work will not begin until any required deposit has been received. We reserve the right to suspend or discontinue work on a project where payment obligations are not met.

Warranty Disclaimers

We stand behind our work. Any warranty terms specific to your project will be stated in your written proposal. In the absence of a specific warranty statement, the following general terms apply:

• Workmanship warranties cover defects resulting from our application and preparation methods
• Warranties do not cover damage caused by improper use, abuse, chemical exposure not disclosed before work, or conditions that develop after project completion
• Warranties do not cover natural concrete movement, settling, or cracking unrelated to our work
• Product manufacturer warranties, where applicable, are separate from our workmanship warranty

Except as expressly stated in a written warranty, all services are provided "as is" without any additional warranty, express or implied, including implied warranties of merchantability or fitness for a particular purpose.

Limitation of Liability

To the fullest extent permitted by applicable law, New Smyrna Beach Epoxy Flooring & Concrete Polishing will not be liable for any indirect, incidental, consequential, special, or punitive damages arising out of or related to services performed or the use of our website, even if we have been advised of the possibility of such damages.

Our total liability to you for any claim arising out of a specific project will not exceed the total amount paid by you for that project. This limitation applies regardless of the legal theory under which a claim is brought.

Website Use

These Terms and Conditions are governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law principles. Any dispute arising under these terms will be subject to the exclusive jurisdiction of the courts of Florida.

Modifications to These Terms
